Actor Sizemore Sentenced for Probation Violation



LOS ANGELES (Reuters) - Actor Tom Sizemore was sentenced on Thursday to 21 months in jail on a probation violation stemming from his conviction for beating his ex- girlfriend, former "Hollywood madam" Heidi Fleiss.

Sizemore, 43, who played combat-hardened soldiers in the war films "Saving Private Ryan" and "Blackhawk Down," remained free on $25,000 bail pending the outcome of his appeal in the Fleiss case, but he was ordered by a second judge to enroll in a court-approved drug rehab program within three weeks.

Still, the actor was jubilant as he walked out of the Los Angeles courthouse between the two sentencing hearings, declaring, "I'm free, I won. Free at last!"

He also had derisive words for Assistant City Attorney Robert Cha, the prosecutor in the Fleiss matter, saying, "He's a chump, he's a C-student, he's a piece of garbage."

His remarks to reporters contrasted sharply with his demeanor in court, where he tearfully begged the judge for "a second chance" in sparing him a much tougher sentence sought by prosecutors -- 4 1/2 years' imprisonment.

Sizemore ended up back in court after failing a series of drug tests required as a condition of his probation for his 2003 domestic violence conviction in the Fleiss case and a separate guilty plea last fall for possessing methamphetamine.

In February, Sizemore was briefly jailed for trying to use a prosthetic penis sewn into boxer shorts and filled with a clean urine sample to fake a drug test sample.

Whether Sizemore ever serves the 21-month sentence imposed by Los Angeles Superior Court Judge Antonio Barreto Jr. depends on whether his conviction in the Fleiss case is upheld on appeal, a case that may take another 18 months to be heard.

Sizemore's lawyers said that even if he loses the appeal, the actor would only serve at most 10 months in jail, taking into account routine adjustments to his term.

MAXIMUM SENTENCE URGED

But Deputy District Attorney Sean Carney told reporters Sizemore faces up to three years in state prison if he fails to complete the court-ordered rehab.

During sentencing, Cha argued that the actor had shown no contrition for his behavior, had refused to accept responsibility for it and deserved the maximum punishment.

"The defendant has been coddled and enabled, based on his celebrity," Cha said. "He's deflecting blame."

Sizemore reacted with visible derision during much of the hearing, rolling his eyes, mocking the prosecutor and making gestures of exasperation.

But sobbing openly through his own rambling statement to the judge, Sizemore insisted he was truly remorseful.

"I'm not acting out. I'm begging. I'm beseeching. I cannot imagine my future without performing. I'm a good person. That's what I want people to know."

The actor acknowledged that he suffers from substance abuse -- "part of who I am is a person with a disease" -- but said he was "getting better." He also said his ordeal had brought him closer to his parents, who were present for the hearing.

Sizemore later said he planned to return Thursday evening to the set of his latest film, "Fear Itself," and would begin shooting another film, "Splinter," next week. He plays a corrupt cop in that movie.

Burt Reynolds Slaps Television Producer

Burt Reynolds apparently slapped a CBS-TV assistant producer in the face at a New York screening of his new film, "The Longest Yard."

The producer, who works for CBS News PATH, approached Reynolds on the red carpet outside a Chelsea theater Tuesday night. When he asked Reynolds to tell him about the film, the actor seemed annoyed.

"You don't know anything about the movie?" Reynolds replied.

The producer acknowledged he hadn't seen the movie or the original 1974 film. Reynolds then seemed to slap the producer. "What ... kinda of guy are you?" he asked.

CBS aired footage of the incident on "The Early Show" Wednesday morning.

Jeff Lane, a spokesman for Reynolds, said in a statement that Reynolds "playfully tapped (the producer) on the cheek, as if to say, `Well, that's not very nice.' He was kidding."

Slater Arrested for Alleged Groping

Actor Christian Slater was arrested early Tuesday and charged with groping a woman on a Manhattan street, police said.

Slater, 35, was accused of touching the woman's buttocks near 93rd Street and Third Avenue on the Upper East Side around 1:50 a.m., said a police spokesman, Detective John Sweeney.

The woman, who was not identified, flagged down police to report the incident, Sweeney said. Slater was found nearby and the woman identified him as the man who groped her.

Slater, who's appearing on Broadway in "The Glass Menagerie" was arrested on a charge of third-degree sexual abuse. He was expected Tuesday in Manhattan Criminal Court.

Slater starred in the 1980s classic "Heathers," as well as "True Romance," and "Untamed Heart" in the 1990s.

In August 1997, he was arrested after he allegedly bit a man in the stomach and threw a police officer against a wall during a rowdy party in Los Angeles. The actor later pleaded no contest to the charges and served 90 days in jail.

He filed for divorce earlier this year from television producer Ryan Haddon. In 2003, Haddon was accused of hitting him with a drinking glass during a fight in their Las Vegas hotel room. She was jailed briefly but no charges were filed.

Russell Crowe appears in court

Actor arrested on charges related to phone-throwing incident




NEW YORK (CNN) -- Actor Russell Crowe was arraigned Monday afternoon in Manhattan Criminal Court on charges of second degree assault and fourth decree criminal possession of a weapon for allegedly throwing a hotel telephone that struck a hotel employee in the face.

According to the criminal complaint accompanying the charges, Crowe admitted to the arresting police officer that he picked up the phone and threw it at the Mercer Hotel concierge "because he was angry," the Manhattan District Attorney's Office said.

NYPD Sgt. Michael Wysokowski earlier told CNN that Crowe "was upset because he couldn't get a call out to Australia."

Police said the victim was transported to St. Vincent's Hospital. Crowe was booked into the First Precinct and later escorted out, wearing handcuffs and sunglasses, for his arraignment.

His next court appearance was set for Sept. 14, the D.A.'s office said.

Universal Studios -- which released Crowe's latest film, "Cinderella Man" -- said it had "no comment" on the incident.

CNN has been unable, so far, to reach the actor's publicist, Robin Baum, or his attorney, Gerald Lefcourt.

Crowe was in New York promoting "Cinderella Man," a biopic based on the life of world heavyweight champ James J. Braddock, which opened in theaters last weekend.

According to Nielsen the movie ranked fourth place in theaters and grossed $18.6 million.

Crowe won an Oscar for Best Actor in 2001 for his movie "Gladiator."

Colin Farrell Sues Woman Over Sex Tape

LOS ANGELES - Actor     Colin Farrell is suing a woman for allegedly trying to distribute and profit from a sex tape he says the two recorded with the agreement they would never make it public.

The lawsuit filed Monday in Superior Court seeks general and compensatory damages as well as a temporary restraining order and injunction prohibiting the sale and exploitation of the videotape.

Farrell, 29, accuses Nicole Narain of trying to distribute the tape through an intermediary. The two had an intimate relationship 2 1/2 years ago and both agreed that the 15-minute tape that shows the couple having sex would be jointly owned by them and would remain private, according to the suit.

Narain could not be reached for comment. A call to a phone number listed for her revealed the number had been disconnected.

A message left for Farrell's attorney was not immediately returned Monday.

The lawsuit also accused the 31-year-old woman of working with the owner of an Internet pornography business and contacting the news media about the tape.

"Defendants' outrageous attempt to capitalize on the celebrity of plaintiff Colin Farrell ... through their unauthorized commercial exploitation of the highly private and confidential videotape exceeds all bounds of common human decency," the lawsuit states.

The lawsuit also said the release of the videotape would irreparably harm Farrell's reputation and career.
