David, "Curb" making room for Fox

Vivica A. Fox has joined the cast of
Larry David's "Curb Your Enthusiasm" for the HBO comedy's upcoming sixth season.

She will be a member of a black family that moves into the Davids' house following a major natural disaster.

The story line, seemingly a take on the events following Hurricane Katrina, is sure to explore interracial relations, something "Curb" has done brilliantly with such classic episodes as "Krazee-Eyez Killa" and "The Carpool Lane."

The topic is in Hollywood's spotlight these days, following the racial outburst of
Michael Richards, co-star of the hit comedy "Seinfeld," which David created with
Jerry Seinfeld.

Fox recently starred in the Lifetime drama series "1-800-Missing" and did a multi-episode arc on the UPN comedy "All of Us," which has since migrated to the CW.

The Los Angeles City Council agreed Wednesday to pay $320,000 to settle a lawsuit by a man who was cleared of murder when footage shot for the HBO comedy "Curb Your Enthusiasm" showed him at a Dodgers game when the crime occurred.

Juan Catalan had filed a police misconduct suit against the city after spending nearly five months in jail for a crime he did not commit — a point his lawyer proved after producing outtakes from the television show.

In the scene, which ended up on the cutting room floor, Catalan could be seen eating a hot dog in the background.

Catalan, 28, was arrested in the May 2003 murder of Martha Puebla, 16, outside her Sun Valley home, even though he told detectives that he was innocent and had been at a Dodgers game with his 6-year-old daughter at the time of the crime.

Catalan's defense attorney, Todd Melnik, went through footage of crowd shots from the televised game between the Dodgers and the Atlanta Braves, but he did not find his client. Then he learned that the HBO comedy starring former "Seinfeld" co-creator Larry David had been shooting at the ballpark that day.

HBO allowed Melnik to look through the footage, and he found a shot of Catalan with his 6-year-old daughter and two friends. The footage was time coded, confirming that Catalan was at the ballpark shortly before the time of the slaying 20 miles away in the San Fernando Valley.

"There he was in the outtakes," said Gary S. Casselman, the attorney handling Catalan's lawsuit. "He's glad it's over. It's terrible to be in jail, and he thought he would never see his daughters again."

Catalan, who worked at his family's machine-tool business in Sun Valley, became the focus of the police investigation into the slaying of Puebla because she had testified in a murder case in which Catalan's brother, Mario, was a co-defendant.

Someone else is now being prosecuted for the slaying, Casselman said.

Records of a cellphone call, made from Dodger Stadium, between Catalan and his girlfriend also helped persuade a judge to release him, but the footage from the comedy show cemented his alibi.

Catalan was not a fan of "Curb Your Enthusiasm" before his time in jail. "He is now," Casselman said.

On Wednesday, the City Council also agreed to pay $150,000 to settle a lawsuit by Valentine Garcia Sr., alleging that the police used excessive force against his son, who was shot to death by two police officers at the Greyhound bus station in Los Angeles in July 2004. That incident was captured on videotape by surveillance cameras.

Council President Eric Garcetti said the two cases demonstrated that in a high-tech media age, actions by the police are subject to oversight by cameras.

"There is a real positive element to video," Garcetti said. "It's one of the reasons we are putting video cameras in police cars. It doesn't lie. It doesn't always tell the whole story, but it's a good way of ensuring that all of our officers are held accountable."

The bus station death of Erick Jerome Garcia, 36, was called a "problem shooting" by Los Angeles Police Chief William J. Bratton because at the same time the fatal shots were fired, a third officer decided to use a less-than-lethal weapon, a stun gun, on the man. Later, the Police Department ruled that the shooting was within policy because Garcia was brandishing a 6-inch metal rod resembling a tent spike that he refused to drop.

Garcia was struck as he crawled through an opening for a baggage scale beneath a ticket counter. The surveillance cameras enabled investigating officers to view the shooting from five different angles. Parts of the videotape were shown to the City Council in a closed session Wednesday.

The enthusiasm is gone: Larry David and his activist wife, Laurie, have separated after 14 years of marriage. The split was "very amicable and ... they're going to continue to raise their two (daughters) together as friends," spokeswoman Heather Lylis said Tuesday.

No further details were provided.

David, 59, is the star and creator of the HBO hit comedy "Curb Your Enthusiasm," which chronicles the always strange daily doings of its curmudgeonly centerpiece. The TV Larry David's much put-upon wife is played by Cheryl Hines.

David also co-created the NBC classic "Seinfeld."

Laurie David produced "An Inconvenient Truth," the global-warming movie that won the Oscar for best documentary. In April, she accompanied singer Sheryl Crow on a college tour to raise awareness about climate change.

Karl Rove, Laurie David, and Sheryl Crow -- The Real Story   [Byron York]
I just got an eyewitness account of the Karl Rove-Laurie David-Sheryl Crow encounter at the White House Correspondents Dinner Saturday night, and it suggests that David and Crow were a bit more confrontational than they portrayed themselves in their own account of the incident, published in the Huffington Post.  In their story, David and Crow write, "The 'highlight' of the evening had to be when we were introduced to Karl Rove.  How excited were we to have our first opportunity ever to talk directly to the Bush Administration about global warming."

The eyewitness says the person who introduced David to Rove was the New York Times' Maureen Dowd.  I want you to meet Laurie David, Dowd said to Rove.  (These are all approximate recollections, so no quotation marks.)  Dowd said David would like to say hello.

According to David and Crow, the encounter began with a polite request.  "We asked Mr. Rove if he would consider taking a fresh look at the science of global warming," they write.  "Much to our dismay, he immediately got combative. And it went downhill from there."

The eyewitness remembers it a bit differently.  Immediately after Dowd's introduction, the witness says, David began lecturing Rove about global warming.  This administration has done nothing on the issue, she told Rove.  We face a crisis.  The time to act is now.  This administration has done nothing...

At that point, Rove broke in to say, Well, actually we have done something.  Rove mentioned global climate research, at which point David broke in herself to say, You just don't understand. All these questions have been answered.  That's worthless.  That's useless.

In their account, David and Crow write, "We reminded the senior White House advisor that the U.S. leads the world in global warming pollution and we are doing the least about it. Anger flaring, Mr. Rove immediately regurgitated the official Administration position on global warming which is that the US spends more on researching the causes than any other country."

The eyewitness says Rove asked David if she had read the IPCC report, referring to the United Nations' Intergovernmental Panel on Climate Change, which, while confirming a human role in climate change, substantially undermines some of the most catastrophic charges made in Al Gore's "An Inconvenient Truth," which David produced.  David said she had read the report.  "We felt compelled to remind him that the research is done and the results [the IPCC report] are in," David and Crow write.  "Mr. Rove exploded with even more venom. Like a spoiled child throwing a tantrum, Mr. Rove launched into a series of illogical arguments regarding China not doing enough thus neither should we. (Since when do we follow China's lead?)" 

In the eyewitness' version, again, David and Crow are a bit more aggressive than their own story suggests. The eyewitness says David told Rove, You need to bring in new people to tell you the truth. Rove mentioned Dr. John Marburger, the White House science advisor.  At that point, according to the eyewitness, Crow began poking Rove's chest with her finger, demanding to know what corporations were underwriting Marburger's work.  Rove said Marburger had been in academia most of his career.

With Crow jabbing him in the chest, Rove turned to take his seat.  Then, the witness says, Crow grabbed his arm.  A few more words were exchanged, and it was over.  At the Huffington Post, David and Crow described the ending this way: "In his attempt to dismiss us, Mr. Rove turned to head toward his table, but as soon as he did so, Sheryl reached out to touch his arm. Karl swung around and spat, 'Don't touch me.' How hardened and removed from reality must a person be to refuse to be touched by Sheryl Crow? Unfazed, Sheryl abruptly responded, 'You can't speak to us like that, you work for us.' Karl then quipped, 'I don't work for you, I work for the American people.' To which Sheryl promptly reminded him, 'We are the American people.'"

In light of the eyewitness' account, another way of saying it might be, How hardened and removed from reality must a person be to refuse to be jabbed in the chest by Sheryl Crow?

Girls don't separate anymore. When was the last time you heard a girl say she was separated from her husband? 1992? Nowadays, they divorce right off the bat and run off with the money.
